Standard ticketing conditions

The conditions of the agreement between 4SITE Perisher Pty Ltd (ABN 15 666 629 509) owner and operator of the 4SITE Accommodation Transfer Service ("4SITE"), the purchaser and/or user of this ticket and any person who accompanies them (“passenger”) are set out below:

  1. Limitation of Liability: Without affecting any basis on which the liability of 4SITE is limited by law, the passenger and his/her property are carried entirely at his/her own risk. 4SITE will not be liable for:

    1. death, sickness of or any other injury to any passenger or for any other injury, loss or damage suffered by the passenger, however arising; and

    2. loss of or damage to any personal effects, luggage or other goods, whether or not such loss or damage is suffered, or is caused by anything occurring before, after, or in the course of any journey,

except where clause 1(a) or clause 1(b) can be attributed to the fraudulent, negligent act or omission of 4SITE.
4SITE will not be liable for refusing to carry, or the removing from the service, a passenger or their items under these terms and conditions.

  1. Tickets: Passengers must show their ticket to 4SITE staff as a condition of travel on the bus. Passengers who have purchased a ticket online from the 4SITE Website must present a unique QR code (either as a printout or on their portable electronic device) to the driver. Tickets are non-transferable, may not be duplicated, and are non-refundable. A return trip ticket must be used on separate journeys.

  2. Schedule: 4SITE will use reasonable efforts to meet stated departure and arrival times but 4SITE does not promise to meet those times and will not be liable for any failure to meet those times. Without limiting the previous statements, specifically 4SITE cannot be held liable for delays due to road conditions, traffic volumes, weather conditions or incorrect bookings made by third party agents. 4SITE shall not be liable for any direct or indirect loss or damage arising out of or consequential upon any abandonment of, delay in departure or delay during any trip that is beyond the control of 4SITE.

  3. Refunds: Subject to these terms and conditions, 4SITE will not refund any part of the fare if a passenger elects not to travel.

  4. Rescheduling: 4SITE will allow a guest to reschedule a ticket up to 24 hours prior to a booked transfer. Re-scheduling will be completed via the website or contacting 4SITE.

  5. Statutes: These terms and conditions apply to the extent that they are not inconsistent with or in contravention of any obligation imposed upon 4SITE by virtue of the provisions of the Bus Safety Act 2009 (Vic), the Australian Competition and Consumer Act 2010 (Cth) or any other applicable legislation whether State or Commonwealth.

  6. Infants & Children: Children aged 15 years and under are not permitted to travel alone on our vehicles and must travel with a parent or guardian. Children aged 16 years and over may travel alone but their supervision and safety remains at all times the sole responsibility of their parent or guardian.

  7. Smoking: Smoking is not permitted on board or within four metres of our vehicles or waiting facilities used for our service.

  8. Alcohol, Drugs and Anti-Social Behaviour: 4SITE may refuse to carry, or may remove from service a passenger who, in the reasonable opinion of 4SITE or the driver:

    1. is affected by drugs and/or alcohol; or

    2. threatens or poses a risk of violent, abusive or aggressive behaviour; or

    3. such passenger or their luggage may cause disturbance, distress or discomfort to any other passenger or the driver.

Violence, abuse or aggression in any form will not be tolerated. All incidents will be reported to the police.

  1. Food: Consumption of food or drinks (except water in screw top containers) is not permitted on board our vehicles. Hot food and hot drink, irrespective of the container/vessel used, is also prohibited on-board.

  2. Baggage: Each paying guest is entitled to three large items. The number of bags must be entered at the time of purchase, otherwise 4SITE cannot guarantee the transfer of luggage. Additional baggage can be purchased, limited to 2 extra bags per transaction, subject to availability of space on the relevant trip. Passengers may be asked to travel on a subsequent vehicle if, in the driver's reasonable opinion there is insufficient space or the baggage and/or additional items may be a safety hazard. Passengers are responsible for the protection of fragile items. Passengers must ensure that no item causes any danger, obstruction or inconvenience to other passengers, the driver or the vehicle. Carriage of any item may be declined if, in the reasonable opinion of the driver or 4SITE, it may cause any danger, obstruction or inconvenience whatsoever.

  3. Credit Card: 4SITE may charge an additional reasonable fee for processing payment by credit card. The fee will vary depending on the type of credit card used.

  4. Fares: All fares are subject to change without prior notice without affecting valid tickets already purchased.

  5. CCTV: Passengers agree and acknowledge that by boarding the bus they will be filmed by CCTV footage and that this footage may be used by 4SITE in compliance with the 4SITE Privacy Statement and the Privacy Act 1988 (Cth).

  6. Emergencies: Without limiting any other entitlement of the driver to direct passengers, each passenger agrees that in the case of an apparent emergency or breakdown, the driver may direct passengers to leave or reboard a vehicle, to move to a particular place of safety or to another bus or to take such other actions as appear reasonable to 4SITE or the driver at the time.

  7. Assistance Animals: Guide dogs, hearing guide dogs, guide dogs in training and animals covered by the Assistance Animal Pass (which must be available and produced on demand) are permitted to travel on a 4SITE vehicle.
